Conflict of Interest policy
At ANZCA’s October Council meeting, a Conflict of Interest policy was approved. The purpose of the policy is to provide guidance in identifying and handling potential and actual conflicts of interest involving the College and its activities.

Regulation 27

PERFORMANCE ASSESSMENT OF ANAESTHETISTS (ASSISTANCE TO OUTSIDE BODIES)

ANZCA does not assess performance of specialists, however, on request, the College will provide advice to the relevant National and State/Territory Authorities in Australia, and in New Zealand.  The College must assist with the review of clinical performance of an anaesthetist when this is considered necessary for the purpose of ensuring patient safety.

The following principles will be adopted by the College:

27.1   Selection and Appointment of Assessors

The College will nominate Fellows to form a panel from which the relevant regulatory authority or employer may choose Fellows to assist with performance review.

27.2   Duties of Assessors

Assessors selected from the panel by the relevant regulatory authority or employer will act entirely on behalf of the authority requesting the review, which will indemnify the assessors, and provide for any expenses involved in the review.

27.3   Performance Review in Anaesthesia

Assessors conducting a performance review will utilise the methods chosen by the regulatory authority or employer, which may include, but are not limited to:

27.3.1   review of participation in Continuing Professional Development Programs such as MOPS.

27.3.2   review of relevant clinical records.

27.3.3   audit of processes used for patient management.

27.3.4   structured discussions with medical and non-medical staff involved with the work of the doctor being reviewed.

27.3.5   consideration of information produced by, or on behalf of the doctor being reviewed.

27.3.6   discussion with the doctor being reviewed.

27.4   Report of the Review Panel

The review panel will report to the authority requesting the review.  The report will be provided to the doctor being reviewed unless this will be done by the authority requesting the review.

27.5   Responsibilities of the College if Retraining is Required

Should the authority requesting the review then request that the College co-ordinate retraining, the College may assist with placement of the doctor for retraining; will recommend an appropriate Fellow to the assessing authority to oversight retraining for the authority; and may nominate a mentor acceptable to the doctor.
